In this article I focus on the possibility of applying to mediation in the perspective of how and in what sort of conflicts could be the mediation an adequate way in the economic conflicts resolution. I don’t rely on any empirical research concerning this topic1, therefore this paper is an attempt of thought-provoking and a sequence of hypotheses. The reason of my theoretical approach is that the mediation haven’t been relevantly applied in the situations I focus on. The purpose of this study is to point to conflict types where the mediation could be a relevant and useful technique on the other hand it sketches the positive and negative sides of the methods from the point of sociology and economy.

The backbone of the paper is the perspective that I consider this alternative method, which might seem not more than a technique scientific content, because I rely on a lot of economy sociology principles and I handle the mediation not in ad hoc way but as a deliberate technique which has the possibility to built cooperation and integration in the economy.

My thoughts maintenance the common parts of the sociology and economy theory in the perspective of that in certain economy relations the mediation what kind of function can have in order to increase the economical performance and productivity. In the background of this approach sociological and economical theories stands. In one respect the newest economical researches found that the increasing of the company productivity depends on the following very important facts: what kind of organizational culture it has, what kind of and how important the cooperation in their strategy thinking, how extended network it has, and finally it depends on the sociological embedded of the company. Otherwise in the last few year numerous researches on the connection of the productivity and network system proved that a company is able to run for long time in efficiency way if in certain tasks it could collaborate with other market participants.

In the first part of the study I shortly summarize the types of the inter-companies connections which are built on a kind of collaborative strategy or system. With this, I want to outline and prove that the conditions of the applying of mediation are theoretically given in the economy system. After this I express the micro and macro conditions of a successful inter-company mediation and I give some examples for conflicts types which could be handled with mediation. In the third part of the paper I write on the general features of the inter-companies conflicts which could affect the promise of the method. In the end I script the consequences of the method in prospect of sociology and economy.

Why mediation?

The most often applied conflict resolution methods to the economical conflicts are the arbitration, negotiation and conciliation. The mediation hasn’t been a popular techniques at all or maximum in very special situations in inter-companies conflicts resolution. I still string my thoughts on the mediation way that I can justify with the followings.

Arbitration is an alternative mode, in which the arbitrator as a third outside person makes the decision. In the contradiction to mediation, it means that the possibility of the autonomy of decision-making slips out the partners being in dispute. On the other hand arbitration works as a quasi jury and the decision usually ended by the wining of the one and the loosing of the other. Third, during the arbitration process the significance of the communication is differences and it applies other communication strategy as the mediation does.
